TERMS & CONDITIONS
By 'CDEXPRESS.COM' and 'Rockhouse Records', both trading names of Platenboer B.V., are being meant furtheron in these conditions as the closed partnership(official company form)with limited accountability, stationed and keeping office in Weesp, The Netherlands and registered at the Chambre of Commerce under no. 28034240 in the city of Leiden.
General / Application
2.1 - These general conditions are with the explicit exclusion of any other condition adaptable to all judicial relations, in which Rockhouse Records acts as the deliverer of products.
Offers
3.1 - All offers by Rockhouse Records are non obligatory. Offers are only valid under the condition of deliverability of the produduct offered. Rockhouse Records has the right to nullify an agreement to buy a product.
Prices
4.1 - All prices are 'Ex Warehouse', dutch V.A.T included, but excluding all other importduties imposed by Governments and excluding mailingcosts, unless differently listed in the information attached to the product.When the buyer is not present in the country where the productmailing is sent from, then the buyer will be responsible for V.A.T and importduties in the country where the product is received.
Delivery / Delivery period
5.1 - The deliveryperiods meantioned on the internetsite are to give an indication and are not to be seen as a definite term. Rockhouse Records can never be held resposible or is in any way liable for damages as a consequence of exceeding a period of delivery.
5.2 - Delivery is conducted 'Ex Warehouse'. Rockhouse Records will take care of delivery by mail or sending in any other way of choice by Rockhouse Records, however at charge and risk for the buyer. Delivery by mail or sending in any other way wil only be executed after payment for the ordered products has been received by Rockhouse Records . The ownership of products shifts to the buyer upon delivery.
5.3 - Rockhouse Records is justified to deliver in portions. Redelivery of one and the same order will be delivered for half of the normal mailing costs.
Complaints, researchobligation, superannuation and not following up
6.1 - Claims due to defects of the products are to be submitted as soon as possible in writing, but at least within 14 days of delivery or when a non visible defect occurs-within 21 days of the moment that the defect reasonably could be detected.
6.2 - Claims and reproaches, based on facts which can support and justify the claim, that the delivered goods do not complie to the agreement, superannuate one year after reception of the product by the buyer.
6.3 - When the delivery does not complie with the agreement, Rockhouse Records can only be held accountable to deliver the undelivered goods, reparation of any delivered product or replacement of any delivered product.6.4 The customer must return a product within 2 weeks from delivery, with full refund of the purchase sum without reason.Mailingcosts due to returning products have to be paid for by the buyer. 6.5 The customer must return a product with a defect within 1 week from delivery, with full refund of the purchase sum .Mailingcosts due to returning products will be paid for by Rockhouse-Records.
Damages and reparation
7.1 - Rockhouse Records can only be held responsible for damages, which can be attributed to severe negligence or mal intent, or appearing circumstances based on law enforcing regulations which belong to her risk department.
7.2 - Circumstances, which in any case are not in the realm of risk of Rockhouse Records are: Workingstrike, personel exclusion, sickness, import, export and/or transitprohibitation, transportdifficulties, not following up of obligations by wholesalers, disruption in the manufacturing of the products, nature and or nucleairedisasters, war and/or the threat of war, can never be blamed on Rockhouse Records, outside severe negligence or mal intent.
7.3 - Rockhouse Records can never be held to pay damages or reparation different then business or personal damage.
7.4 - The statement in this article does not relief Rockhouse Records of its legislative responsibilties.
Applied law / Authorized judge
8.1 - Rockhouse Records will not at any time provide any customer information to third parties whatsoever.
8.2 - Dutch law applies to all judicial relations between Rockhouse Records and a buyer.
8.3 - All disputes which may appear as a result of an agreement at hand or of any further agreements, which may be a consequence of that, will be dealt with by in accordance with the 'Reglement van het Nederlands Arbitrage Instituut'(Rules of the Dutch Arbitrary Institute) or, if Rockhouse Records chooses, the authorized judge in the residential area or habitat of Rockhouse Records or the buyer. The arbitrary matter will consist of one arbiter. The city where the dispute will be settled is Amsterdam, The Netherlands. The poceeding will take place in the dutch language. The arbitrage will decide according to the rules of justice.
